A lawsuit was brought by three disgruntled members of the Peoples Democratic Party (PDP) to prevent the party’s national conference from electing new national officials in November 2025. On Friday, October 31, 2025, Justice James Omotosho of the Federal High Court in Abuja suspended the PDP’s scheduled 2025 National Convention until the party complies with the Electoral Act, the Constitution, and the party’s statutory obligations. The judgment also prohibited INEC from accepting a report on the party’s national convention results unless it adhered to the law’s due process requirements and its rules and regulations.

Debo Ologunagba, the PDP’s national publicity secretary, stated that the party will move forward with the procedures and events leading up to the national convention. The PDP has instructed its legal team to challenge the ruling, which it called an attack on Nigeria’s democratic processes.

In an unexpected development, the PDP has been given permission by the Oyo State High Court in Ibadan to move forward with its planned elective National Convention on November 15 and 16, 2025. Folahan Malamo Adelabi, a candidate for the post of Deputy National Organizing Secretary, filed the action in suit No. I/1336/2025.

The claimant effectively proved the need for immediate judicial action, according to Justice A.L. Akintola, the presiding judge, who heard the request on Monday, October 3, 2025.

“The court finds merit in the claimant’s motion ex parte. The same succeeds and is hereby ordered as prayed.” Consequently, the judge issued the order following an ex parte application filed by Folahan Malomo Adelabi.

  • He directed Umar Damagum, the national chairman of the Peoples Democratic Party (PDP), to proceed with the party’s planned national convention in Ibadan on November 15.
  • directed INEC to send observers and monitors to the convention in order to guarantee complete adherence to election regulations, strengthening the legitimacy and openness of the process.
  •  He gave the National Convention Organizing Committee (NCOC) Chairman, Umaru Ahmadu Fintiri, instructions to move forward with all exercise-related preparations.
  • The court approved the requested interim orders, requiring the defendants to hold the national convention on the scheduled date and prohibiting any interference with the PDP’s calendar and operations.

The hearing of the motion on notice for an interlocutory injunction was postponed until November 10, 2025, by Justice Akintola. The principal registrar, S. O. Hammed, signed the court’s order dated November 3, 2025, and it was sealed by the Oyo State High Court.
